General terms and conditions
Article 1 - Goods
We sell women's clothing.
Article 2 - Payments
The (total) price of the goods is stated in our web shop. You pay through our online payment service; Mollie provides this payment service. The shipping costs are at your expense.
Article 3 - Deliveries
We deliver your goods to the address you provided when ordering. You cannot change the address once we have sent the package. As soon as the package is sent, you will receive a track & trace code from us with which you can follow the order. We do our best to deliver the order within 1 day. If the order is delayed, we will inform you in writing. We guarantee that you will receive the order no later than 3 days after confirmation of the order. We ship throughout Europe and outside the Netherlands it may take up to 7 days before you receive your order.
Article 4 - Returns
You can always return the goods within 14 days after receipt. You can do this with the return form or by sending an email to info@vivafashion.nl. After you have received confirmation from us, you must send the goods back within 14 days. Once we have received the goods, we will refund the full purchase price within 14 days. The costs for returning are at your expense. During the period you consider keeping the goods, you must handle the goods and packaging carefully. You may only unpack and use the goods as far as necessary to determine whether you want to keep the goods. Tights, underwear, socks, earrings, if worn, cannot be returned.
Article 5 - Liability
We are not liable for damage caused by the use of a product. This does not apply if the damage was caused by intent, gross negligence or conscious recklessness on our part. Your right to compensation will in any case not be higher than the amount of the ordered and paid product.
Article 6 - Intellectual Property Rights
All intellectual property rights (such as: copyrights, logos, word marks) on our texts, photos, images and other materials are our property (or are under our control with permission from the owner). Your use may not infringe on this.
Article 7 - Complaints Procedure
If you have a complaint about the execution of the agreement, please let us know. Send your complaint as soon as possible (and as fully described as possible) to info@vivafashion.nl. We will handle your complaint as soon as possible, at the latest five days after we have received your complaint. If it takes longer to handle the complaint, you will receive confirmation of your complaint within 48 hours and we will let you know when we expect a substantive response. If we cannot resolve the complaint mutually, a dispute arises that falls under the dispute resolution scheme.
Article 8 - Dispute Resolution
These general terms and conditions and the agreements we make with you are governed by Dutch law. In case of a dispute, the court in Amsterdam has jurisdiction.
